Bidding Process: This auction will take place via online auction with a soft close, Bidding will be open now until Monday July 22nd @ 10AM EST, If any bids are placed within the last 5 minutes of the auction, bidding will extend 5 additional minutes until there is 5 consecutive minutes without bidding activity 

 

Terms of Sheriff Auction:

Auctioneer is authorized to charge and retain a buyer premium of four percent (4%) of the bid amount from the highest third party bidder (the “Buyer Premium”). Said Buyer Premium will be paid by the highest third party bidder, to Auctioneer, and shall be in addition to the amount of the winning bid entered by the highest third party bidder. Bidding shall be made without conditions and with no contingencies of any kind. The Property shall be sold “AS IS AND WHERE IS” with no representations or warranties of any kind being made to the buyer. Auctioneer shall not be held to answer to any claims whatsoever concerning the condition and/or title to the Property. Auctioneer shall require all third party bidders to provide proof of funds prior to being able to bid at the foreclose sale and a refundable deposit of $20,000.00 (the “Deposit”). After conclusion of the auction, if a third party bidder was the winning bidder, such third party shall by 4PM Eastern standard time on the date of the sale deliver to Auctioneer funds in the amount of the bid price, plus the Buyer Premium less the Deposit, which shall be paid by wire transfer. Any unsuccessfull bidders will receive their $20,000.00 (the "Deposit") back within 24 hours from date of auction. Auctioneer shall facilitate the following to finalize the transfer of the Property: (a.)  The Sheriff’s costs and expenses for the sale are paid out of the proceeds of thesale; (b.) A Clerk’s Return is prepared for delivery to the Sheriff; (c.)  A Sheriff’s Deed and Sales Disclosure Form for the Property is delivered by theSheriff or designated deputy to the buyer; (d.) The Sheriff’s Deed, along with fees and other such documents, as may be required by the Recorder and/or other officials of St. Joseph County, Indiana(“County”) are provided by Auctioneer so that the Sheriff’s Deed will be recorded in the public record; and (e.) The net proceeds of the sale are remitted by Auctioneer to    Plaintiff inaccordance with the Clerk’s Return, which shall account for the gross purchaseprice less any amounts due to Auctioneer, including the Buyer Premium or Credit Bid Fee, sheriff fee, recording costs and auditor fees. Payment toAuctioneer for its expenses and commissions shall be made prior to the payment of any other item, fee, or expense. If there is a third party buyer and such buyer fails to timely deliver the balance ofthe sale price to Auctioneer, then: (a.) Auctioneer is authorized to sell the Property to a backup bidder from theoriginal sale if in the judgment of Auctioneer, the price a backup bidder is willing to pay is a greater amount than a subsequent sale is likely to realize after payment of advertising and other costs for the subsequent sale. If this is not thecase, the sale shall then be reset under the same terms as here in provided. Ineither instance, the buyer’s Deposit shall be forfeited and applied first to the Marketing Expense, then the fees, if any, of the Sheriff, Treasurer, Assessorand/or Plaintiff in connection with the sale; and the remainder shall be split equally between Auctioneer and Plaintiff as payment towards the balance of theJudgment, .(b.)  Alternatively, additional time may be given to bidder for the delivery of thefunds with an additional non-refundable escrow deposit by the bidder and the written agreement of both Auctioneer and Plaintiff. The buyer shall have rights to possession and title to the Property upon buyer’s delivery of the full bid price to Auctioneer and delivery of the Sheriff’s Deed to buyer. The buyer shall be responsible for the payment of all taxes and assessments for installments, which become due and payable after the date of the auction.
